1. Important Notice

The BLVD Holiday Homes 4-Pillar Performance Guarantee (the “Guarantee”) is a limited, conditional commercial undertaking offered by BLVD Holiday Homes Rental LLC (“BLVD”).

The Guarantee does not constitute a guarantee of revenue, occupancy, profit, return on investment, capital appreciation, rental income, asset value, or any other financial outcome.

All marketing statements relating to the Guarantee, including references to “30% higher net yield”, “management fee waivers”, “AED 10,000 payment”, “outperformance”, “performance”, or similar statements, are subject to these Terms and Conditions.

Participation in the Guarantee constitutes acceptance of these Terms and Conditions.

2. Eligibility

The Guarantee shall only apply to properties that:

BLVD may reject, suspend, remove, or discontinue any property’s participation in the Guarantee program at any time where BLVD determines that continued participation is commercially, operationally, or strategically inappropriate.

3. Owner Obligations

As a condition of participation, the Owner shall:

Any act or omission by the Owner that materially affects performance, guest experience, pricing strategy, occupancy, revenue generation, operational efficiency, or marketing effectiveness shall immediately and permanently void the Guarantee.

Once voided, the Guarantee shall not be capable of reinstatement.

4. Net Yield Outperformance Commitment

BLVD’s objective is to position participating properties to materially outperform traditional long-term leasing through professional short-term rental management.

For purposes of the Guarantee:

Definitions

“Net Yield” means the net income calculation methodology determined by BLVD in its sole and absolute discretion.

“Traditional Leasing Benchmark” means the hypothetical annual long-term rental performance value determined by BLVD in its sole and absolute discretion using any information, assumptions, market intelligence, comparable properties, historical leasing data, industry reports, forecasts, internal performance data, or other information BLVD considers relevant.

“Trending Toward” means that BLVD’s internal projections, forecasts, performance models, revenue management systems, and operational assessments indicate that the property is reasonably expected to achieve the applicable performance objective.

BLVD’s determination of Net Yield, Traditional Leasing Benchmark, projections, trends, forecasts, calculations, assumptions, methodologies, and performance assessments shall be final and binding in the absence of manifest error.

BLVD shall have no obligation to disclose proprietary pricing models, algorithms, forecasting methodologies, revenue management systems, internal market data, trade secrets, or confidential business information.

5. Stabilisation Period

The first ninety (90) days following onboarding shall constitute a stabilisation, optimisation, and market-positioning period.

During this period:

Where BLVD determines, in its sole discretion, that a participating property is not Trending Toward the applicable performance objective following the stabilisation period, BLVD may waive its base management fees.

Any fee waiver:

BLVD’s determination regarding any fee waiver shall be final.

7. AED 10,000 Performance Payment

The AED 10,000 Performance Payment represents a limited goodwill remedy and shall only become payable where ALL of the following conditions are satisfied:

Failure to satisfy any one of the above conditions shall automatically disqualify the claim.

8. Claim Procedure

Any claim under the Guarantee must:

Failure to comply with this procedure shall constitute a complete and irrevocable waiver of the claim.

Any approved payment shall be made within sixty (60) days following BLVD’s final determination.

9. Exclusions

The Guarantee shall automatically and permanently terminate and become void upon the occurrence of any of the following:

10. Force Majeure and Market Conditions

The Guarantee shall not apply to any performance impact resulting directly or indirectly from:

Any payment made pursuant to the Guarantee shall constitute full and final settlement of all related claims.

12. Modification and Withdrawal

BLVD reserves the right to modify, amend, suspend, replace, or withdraw this Guarantee for future participants at any time.

Any such modification shall not affect guarantees already accepted in writing by BLVD for existing participating properties unless otherwise agreed.

13. Governing Provisions

This Guarantee forms part of and shall be interpreted together with the applicable Property Management Agreement.

Any dispute relating to this Guarantee shall be governed exclusively by the dispute resolution provisions contained in the Property Management Agreement.

In the event of any inconsistency between marketing materials and these Terms and Conditions, these Terms and Conditions shall prevail.
